PRIVACY POLICY

MPS Co., Ltd. (hereinafter referred to as the “Company”) establishes the following Privacy Policy (hereinafter referred to as the “Policy”) regarding the handling of users’ personal information in connection with the services provided on this website (hereinafter referred to as the “Services”). Article 1 (Personal Information)
“Personal Information” refers to “personal information” as defined in the Act on the Protection of Personal Information of Japan. It means information relating to a living individual that can identify a specific person through details such as name, date of birth, address, telephone number, contact information, or other descriptions contained in such information, as well as data relating to facial features, fingerprints, voiceprints, and other information that can independently identify a specific individual, such as the insurer identification number on a health insurance card (collectively referred to as “Personal Identification Information”).
Article 2 (Methods of Collecting Personal Information)
The Company may request personal information such as a user’s name, date of birth, address, telephone number, email address, bank account number, credit card number, and driver’s license number when the user registers for the Services. The Company may also collect transaction records and payment-related information containing users’ personal information from the Company’s business partners (including information providers, advertisers, and advertising distributors; hereinafter referred to as the “Business Partners”) regarding transactions conducted between users and such Business Partners.

Article 3 (Purpose of Collection and Use of Personal Information)
The purposes for which the Company collects and uses personal information are as follows.
  1. To provide and operate the Company’s Services.
  2. To respond to inquiries from users (including identity verification).
  3. To send emails regarding new features, updates, campaigns, and other services offered by the Company.
  4. To contact users as necessary regarding maintenance, important notices, or other matters.
  5. To identify users who violate the Terms of Use or attempt to use the Services for fraudulent or improper purposes, and to refuse their use of the Services.
  6. To enable users to view, modify, or delete their registration information and review their usage status.
  7. To bill users for paid services.
  8. For purposes incidental to the above purposes of use.
Article 4 (Changes to the Purpose of Use)
  1. The Company may change the purpose of use of personal information only when the revised purpose is reasonably deemed to be related to the original purpose.
  2. If the purpose of use is changed, the Company shall notify users of the revised purpose or publish it on this website by the method prescribed by the Company.
Article 5 (Provision of Personal Information to Third Parties)
  1. The Company will not provide personal information to any third party without the prior consent of the user, except in the following cases or where otherwise permitted under the Act on the Protection of Personal Information or other applicable laws.
    1. When it is necessary to protect the life, body, or property of an individual and obtaining the consent of the individual is difficult.
    2. When it is particularly necessary to improve public health or promote the sound growth of children and obtaining the consent of the individual is difficult.
    3. When it is necessary to cooperate with a national government agency, a local government, or a person entrusted by such authorities in carrying out duties prescribed by law, and obtaining the consent of the individual may interfere with the execution of such duties.
    4. When the following matters have been announced or made publicly available in advance and the Company has submitted the required notification to the Personal Information Protection Commission:
      1. The purpose of use includes the provision of personal information to third parties.
      2. The categories of data to be provided to third parties.
      3. The means or methods of providing personal information to third parties.
      4. The procedure by which the individual may request the suspension of the provision of personal information to third parties.
      5. The method for accepting such requests from the individual.
  2. Notwithstanding the preceding paragraph, the recipients of the information shall not be deemed third parties in the following cases:
    1. When the Company entrusts all or part of the handling of personal information to a third party within the scope necessary to achieve the purpose of use.
    2. When personal information is provided as a result of business succession through a merger or other similar transaction.
    3. When personal information is jointly used with specific parties, provided that the individual has been notified in advance, or can easily obtain information regarding the fact of such joint use, the items of personal information to be jointly used, the scope of the joint users, the purposes of use by the joint users, and the name of the person or entity responsible for managing the personal information.
Article 6 (Disclosure of Personal Information)
  1. When an individual requests the disclosure of their personal information, the Company shall disclose such information without undue delay. However, the Company may decide not to disclose all or part of the information if disclosure falls under any of the following circumstances. In such cases, the Company shall promptly notify the individual of its decision. A handling fee of JPY 1,000 per request will be charged for the disclosure of personal information.
    1. When disclosure is likely to harm the life, body, property, or other rights and interests of the individual or a third party.
    2. When disclosure is likely to significantly interfere with the proper operation of the Company’s business.
    3. When disclosure would otherwise violate applicable laws or regulations.
  2. Notwithstanding the preceding paragraph, information other than personal information, such as history information and characteristic information, will not, in principle, be disclosed.
Article 7 (Correction and Deletion of Personal Information)
  1. If a user’s personal information held by the Company is incorrect, the user may request the correction, addition, or deletion of such personal information (hereinafter referred to as the “Correction, etc.”) in accordance with the procedures prescribed by the Company.
  2. If the Company determines that it is necessary to comply with such request, it shall make the necessary Correction, etc. without undue delay.
  3. If the Company makes a Correction, etc. or decides not to do so pursuant to the preceding paragraph, it shall promptly notify the user of its decision.
Article 8 (Suspension of Use, etc.)
  1. If an individual requests the suspension of use or deletion of their personal information (hereinafter referred to as the “Suspension of Use, etc.”) on the grounds that the information has been handled beyond the scope of the intended purpose of use or was obtained by improper means, the Company shall promptly conduct the necessary investigation.
  2. If, based on the results of the investigation, the Company determines that it is necessary to comply with the request, it shall promptly implement the Suspension of Use, etc. of the relevant personal information.
  3. If the Company implements the Suspension of Use, etc. or decides not to do so pursuant to the preceding paragraph, it shall promptly notify the user of its decision.
  4. Notwithstanding the preceding two paragraphs, if the Suspension of Use, etc. would involve excessive costs or would otherwise be difficult to implement, and if alternative measures can be taken to protect the user’s rights and interests, the Company shall implement such alternative measures.

Article 9 (Changes to the Privacy Policy)
  1. The Company may revise the contents of this Policy without prior notice to users, except where otherwise provided by applicable laws or by this Policy.
  2. Unless otherwise specified by the Company, the revised Privacy Policy shall become effective upon its publication on this website.
